These terms and conditions apply to the sale of Galleriskart ehf.'s products and services to consumers.
The terms, confirmed by confirmation of purchase, are the basis of the transaction.
The terms and conditions and other information on www.galleriskart.is are only available in Icelandic.
These consumer purchases are covered in the Consumer Purchases Act, the Contracts Act, the Electronic Commerce and Other Electronic Services Act, the Jurisdiction Act, and the Privacy Act.
1. Definition
The seller is Galleri Skart ehf., ID number: 540222-0450, VAT number 144022. Galleri Skart ehf. is registered in the Icelandic Companies Register.
Buyer is the person who is registered as a buyer on an account. Buyer must be at least 16 years of age to shop in the online store www.galleriskart.is
2. 30-day return policy
The buyer can return a product purchased from the seller within 30 days, choose a new product or receive a credit note. When returning a product, it must be in its original condition and packaging. The seller reserves the right to verify that the product is in good condition, however within a reasonable time frame. The seller reserves the right to prevent any abuse of the 30-day return right.
2.1 Applies to all products:
• Warranty certificate, purchase receipt or gift certificate required for product returns
• The product must be in its original condition.
• It is preferable that the product is in its original packaging.
• It is an absolute requirement that all accessories are included with the product.
• www.galleriskart.is reserves the right to test the product if necessary within a reasonable time frame.
• 30-day period is based on the date of the original purchase invoice

4. Order
An order is binding when it is registered on the seller's server. This happens when the buyer has confirmed the order in step 3.
The seller is also obligated to fulfill the buyer's order as long as it is in accordance with the product selection and pricing.
All orders where fraud is suspected and/or where a software bug is affecting them will be cancelled.
The buyer has the right to cancel the purchase according to the Consumer Purchase Act, see more in Article 11.
The seller sends the buyer a confirmation when an order is placed, but only if the buyer has registered their email address during the purchase.
The buyer is advised to carefully review the order confirmation when it is received.
You should also make sure that it is consistent with the intended order.
Deviations from the order and order confirmation shall be interpreted as a new offer from the seller that can be declined or accepted.
The buyer also has the right to keep the original order as long as it is in accordance with what the seller offered.
5. Information
The seller provides information about products to the best of his knowledge at all times. The seller publishes all information subject to faults, viruses, printing, display and typing errors in text, prices and images.
Furthermore, the seller reserves the right to cancel all or part of the buyer's order if the product is sold out. In such circumstances, the buyer will be notified along with information about what could potentially be a suitable replacement. The buyer will then have the option to accept that suggestion or cancel the order in its entirety.
6. Price
Prices are constantly changing at the seller due to competition and supplier price changes. Price increases that occur after a customer's order are not reversible. The price that applies is the one that was in effect when the order was placed and is stated on the order confirmation.
The total cost is stated before the buyer finally confirms the order. It states all costs related to the order, such as service, shipping, etc. Only special cases may entail additional costs after order confirmation. Examples include malfunctions, viruses, printing, display and typing errors in text, prices and images.

7. Payment
Payment can be made by debit and credit card and Netgíró. If you pay by credit card, the amount will be debited when the order is processed from stock. If payment for an online order is not received within 1 hour, the seller reserves the right to cancel the order.
Problems with transactions related to a trading account are covered by the account terms.
8. Delivery and delay
Delivery is considered to be within a reasonable time frame from the date of invoice. The purchase process will state what to expect based on the selected shipping method. The seller only delivers products within Iceland.
If delivery is delayed, the seller will notify the buyer along with information about when the order will be ready for delivery or offer a substitute product if the product is sold out.
If you wish to store an unclaimed item in the www.galleriskart.is warehouse, the storage period is a maximum of 2 weeks. If you wish to store an item for longer than that, a monthly storage fee of approximately 5% of the item's value is required.
9. Product review
After the buyer has received the order, he must check whether it is in accordance with the order confirmation, whether anything was damaged in transit, and that all products are in accordance with the product description and are free of defects.
These terms and conditions assume that the buyer has read and familiarized himself with the instructions and/or manual that accompany the purchased product upon delivery.
The normal customer inspection period is considered to be within 30 days. After 30 days, the seller reserves the right to verify the buyer's statement within a reasonable time frame before resolving the buyer's complaint. In most cases, this includes an inspection by an authorized service provider. If www.galleriskart.is assesses that the scratches are due to transportation, the buyer can replace such products immediately if they are returned or the damage is reported within 2 days of receipt by the buyer. The seller reserves the right to reject a request for a return beyond that time if the seal has been broken.
10. Right to defects or deficiencies
If the product is defective or something is missing from the product, the seller is obliged to offer the buyer a repair, a new product, a discount or a cancellation of the purchase. It depends on the circumstances which option is chosen in each case.
Notification of defects must be received verbally or in writing. It is recommended that the notification be received within 7 days of the defect being discovered. For the sake of registration, it is recommended that the buyer send an email about the defect and keep a copy. The seller sends a confirmation of receipt of the email.
The right of consumers (consumers refer to individuals outside of a business activity) to have defects rectified is in accordance with the Consumer Purchase Act No. 48/2003.
The seller reserves the right to verify that the product is defective, however within a reasonable time frame.
11. Liability
The seller's warranties do not entail restrictions on the rights provided for in the Consumer Purchase Act. Warranty for defects in a product is in accordance with the Consumer Purchase Act 48/2003 and is based on the date of purchase to individuals outside of business activities. In the case of sales of a product to a company (business activity), warranty for defects is 1 year from the date of purchase according to the Act on the Purchase of Commodity Goods Act No. 50/2000.
Warranty is not confirmed unless a purchase receipt is presented.
The warranty does not cover normal wear and tear of the device or the use of consumables, i.e. it does not cover devices that are considered normal to last less than 2 years. However, the general complaint period is 2 years. It is normal that replacement can take place between 6-24 months. The warranty is void if the product has been opened or tampered with without the seller's supervision/approval, even though a workshop and/or an authorized party was involved. The warranty is also void if the failure can be attributed to improper or incorrect handling, and the buyer is advised to read the instructions or manual carefully according to Article 10 of these terms.
In some cases, individual products or brands have a longer warranty period. Where applicable, this is stated. The seller is not obligated to participate in giving discounts, replacing products, etc. after the warranty period has expired.
The seller reserves the right to verify that a defect or malfunction is covered by the warranty terms, however within a reasonable time frame. If a warranty issue arises, the seller is obliged to offer the buyer a new product, a discount or a cancellation of the purchase. It depends on the circumstances which option is chosen in each case.
12. Privacy
All personal information received by the seller is treated as strictly confidential and used only for the purpose of completing a transaction.
However, the buyer has the option of receiving an offer via email, and the seller will only use the information required for this purpose, such as a mailing address.
13. Property rights
Sold goods remain the property of the seller until the purchase price is paid in full.
Account transactions or other forms of credit do not remove the seller's property rights until full payment has been received.
14. Resolving doubts
Always try to resolve all issues in the simplest possible way. If that is not possible, the matter can be referred to the Complaints Committee for Services and Liquid Assets hosted by the Consumer Agency. As a last resort, the matter can be brought before the courts. This must be done in Icelandic jurisdiction and in the jurisdiction of the seller.
